Woman sues hospital after sidewalk fall

HUNTINGTON - A Cabell County woman has filed a suit against a local hospital after she fell on a sidewalk and was injured.

Mary Adkins of Huntington filed a suit Oct. 4 in Cabell Circuit Court against St. Mary's Medical Center.

According to the suit, Adkins was leaving the hospital Oct. 7, 2005, when she tripped and fell over a metal protrusion, where a sign or parking meter had been removed from the sidewalk. Adkins claims she suffered severe injuries.

"The metal protrusion over which (Adkins) fell was in the walking path of the sidewalk and was not marked in any precautionary manner," the suit says.

Adkins claims the metal protrusion was a hazard to foot traffic and a hidden danger, which a pedestrian would not expect.

According to the suit, St. Mary's Medical Center was negligent and carelessly breached their duties by failing to provide a safe condition that meets the standard of ordinary care.

In the three-count suit, Adkins claims she suffered injuries to her body and extremities, and physical and mental pain and suffering. She seeks recovery of damages for her injuries.

Attorney Kelley G. Salmons is representing Adkins.

The case has been assigned to Judge David M. Pancake.
