CHARLESTON - A Kanawha County woman has filed a suit against a national convenience store chain, claiming she was injured when she fell at an area gas station.
Tammy L. Johnson of Clendenin filed a suit Oct. 9 in Kanawha Circuit Court against Speedway SuperAmerica LLC.
According to the suit, Johnson went to the Clendenin Speedway on April 29, 2006, with her fiancee, Richard Rhodes. While there, Johnson tripped over an uneven section of the walkway, stumbled forward and incurred severe injuries.
Johnson claims the property was not properly maintained, which caused her injuries. According to the suit, Speedway has a duty to ensure their properties are free of defective and dangerous conditions.
The suit also says that after knowledge of the hazardous conditions, Speedway failed to repair the property.
Johnson claims she suffered injuries to both her body and her mind. She also claims she has suffered substantial general and specific financial damages.
Johnson, through attorney Drew S. Woods, seeks compensatory and punitive damages.
The case has been assigned to Judge Charles King.
