MARTINSBURG - Two Berkeley County residents have filed a suit against a woman who allegedly caused a wreck, seeking a combined $1 million in damages.
Jennifer Friscia and Theodore Wybieracki filed a suit Sept. 28 in Berkeley Circuit Court against Dawn Barbee.
According to the suit, Friscia was driving a 1993 Nissan 4x2 pickup truck near Glengary on Oct. 4, 2005. Wybieracki was a passenger with Friscia.
At the same time, Barbee was driving a 1999 GMC Yukon SUV on the same road and approached Friscia from the rear at a high rate of speed, the suit says.
Barbee tried to pass Friscia on the left, in a no-passing zone, as Friscia was starting a left turn into a driveway. Barbee crashed into the front-left quarter panel area of Friscia's vehicle.
Wybieracki and Friscia claim they suffered serious and permanent injuries, endured pain and suffering and loss of enjoyment of life.
Friscia and Wybieracki seek $500,000, respectively.
Attorney James J. Matzureff is representing Wybieracki and Friscia.
The case has been assigned to Judge Gray Silver.
