Inmate sues jail for third time over fall down steps

CHARLESTON - An inmate at South Central Regional Jail in Charleston has refiled a lawsuit against the jail for a third time after his previous two efforts were dismissed.

Nalone Stallings filed a suit Nov. 6 in Kanawha Circuit Court against South Central Regional Jail, seeking compensation after he fell down more than 20 steps at the jail.

According to the suit, Stallings slipped on a puddle of water Dec. 5, 2004, and fell down the steps, incurring several injuries. He originally filed a suit seeking damages Nov. 27, 2006.

The first suit was dismissed April 16, 2007 and refiled May 18, 2007. It was dismissed Aug. 13, 2007, for lack of notice to the head of the Regional Jail, a government agency, and the West Virginia Attorney General.

In the two-count suit, Stallings seeks judgment against the jail, seeking compensatory and punitive damages.

Attorney Geoffrey I. Ekenasi is representing Stallings. The case has been assigned to Judge Louis Bloom.
