Man sues after he was tackled, knocked off second floor of apartment building

MORGANTOWN - A Monongalia County man filed a suit against a man who tackled him and knocked him through the railing on the second floor of an apartment building.

Michael Moore filed a suit Nov. 6 in Monongalia Circuit Court against David Crites and Crest Point LLC.

Moore was a guest at a tenant of Crest Point on Feb. 1, 2007. According to the suit, at some point during the evening, Crites, who was also a guest, tackled Moore near the second floor railing in front of the door to the apartment.

"Moore and Crites fell through the railing and onto the parking lot pavement below," the suit says.

As a result, Moore suffered serious injuries and damages, including severe and permanent physical injuries, physical pain and suffering, mental anguish, embarrassment, lost wages, loss of earning capacity and loss of his capacity to enjoy life.

According to the suit, Crest Point is negligent by creating a dangerous condition. Moore claims the railing was of poor and substandard quality, and provided unreasonably insufficient support.

Moore has incurred substantial hospital, medical and related expenses. He seeks compensatory and general damages.
