Woman sues CAMC, two doctors over husband's death

CHARLESTON - A Kanawha County woman has filed a medical malpractice suit on behalf of her late husband, who died at a local hospital.

Kathy Carte of Elkview filed a suit Nov. 14 in Kanawha Circuit Court on behalf of her late husband, Teddy Carte. The suit is against Charleston Area Medical Center and doctors Prasuna Jami and Nimish K. Mehta.

Jami is licensed to practice medicine in West Virginia with a specialty in internal medicine. Mehta also is licensed to practice medicine in the state, with a specialty in pediatrics.

According to the suit, Teddy Carte went to the emergency room at CAMC on May 8, 2007, with complaints of left lower pain, fever, chills and a knot on his left calf. He was admitted with a diagnosis of deep vein thrombosis.

The next morning, he had a fever and was in severe pain. By the afternoon, his leg was pulseless and required intubation. He was taken to surgery for a left lower extremity fasciotomy and died shortly after.

According to the suit, an autopsy was performed, which listed Carte's cause of death as severe sepsis, septic shock and septicemia.

According to the suit, the doctors treating Carte, which included Jami and Mehta, failed to properly and timely diagnose Carte's infection, which caused his death.

Kathy Carte claims she has suffered great mental pain and anguish, loss of services, society, guidance and companionship of her husband, as well as incurred various medical and funeral expenses.

Kathy Carte seeks compensatory and punitive damages.

Attorney Richard D. Lindsay is representing Carte. The case has been assigned to Judge Paul Zakaib.
