CHARLESTON - A Kanawha County woman has filed a suit against the City of Charleston, claiming she was injured at the Civic Center.
Gerrie Goff filed the suit Nov. 16 in Kanawha Circuit Court against the city seeking compensation for her injuries.
According to the suit, Goff attended an event Feb. 8 at the Charleston Civic Center. Prior to the event, city workers shoveled snow on the outside second tier walkway.
The suit says the workers shoveled the snow against the wall, blocking the drainage aqueduct designed to release water from the second tier walkway.
However, some of the snow melted, causing water, which then froze, causing the walkway to become slick, the suit says.
At the close of the event, Goff exited through the second tier doors, slipped and fell on the ice.
According to the suit, Goff fractured the right greater tuberosity, the right proximal humerus and a broken rib.
"(The city) knew or should have known that the walkway was icy and failed to give notification of the dangerous condition to plaintiff and the general public," the suit says.
Goff claims the city has a duty to keep the sidewalks, drains and gutters in good repair and free of obstructions.
Goff claims she sustained past, present and future medical bills, lost wages, pain and suffering, annoyance, inconvenience and loss of enjoyment of life.
Goff seeks full and fair compensation.
Attorney Travis A. Griffith is representing Goff. The case has been assigned to Judge Irene Berger.
