Richard Scott Shaffer and Geraldine M. Shaffer v. Patrick E. Gallagher and CTL Engineering of West Virginia

* Prior to purchasing a residence on Anderson Drive in Morgantown, Richard and Geraldine Shaffer contracted with Patrick Gallagher and CTL Engineering for a structural home inspection. Gallagher indicated the house was free of structural defects. Based on that information, the Shaffers completed the purchase of the dwelling. In the fall of 2006, the Shaffers wanted to remove the drivit coating and replace it with cut stone. At that time, they were made aware of numerous long-term structural defects in regard to the siding, stud walls, foundation and supporting structure. The Shaffers had to replace the structural deficiencies at a cost of $50,000. They seek judgment against Gallagher and CTL Engineering for injuries and damages sustained, pre- and post-judgment interest, costs and attorney fees.

Misti Devery vs. Rystan Properties LLC, Tom Deavers, Mottie Paveone, EDMOT LLC and Idlewood Enterprises LLC.

*In March 2007, Misti Devery leased a townhouse at 119 Rystan Place. Shortly after moving in, Devery contacted Idlewood Enterprises, owners of the property, to advise of mold growing at the residence. In August 2007, and twice in September, Devery contacted the new owners of the property, Rystan Properties and Mottie Pavone to advise them again of the problem. Shortly after doing so, Devery moved out. She is seeking judgment for injuries to her health, damages to her property, punitive damages and court costs.

* Brozik purchased a 2007 Lincoln Navigator from Superior Ford in Morgantown. Brozik reported to Superior Motors that the vehicle failed to conform to its express warranties. Ford refused to replace the vehicle. Brozik is seeking judgment for refund of the purchase price, damages for loss of ouse, annoyance and inconvenience, expenses incurred for replacement transportation when the vehicle was out of service, attorney fees, and pre and post judgment interest.
