Mingo man sues after falling at Huntington car wash

HUNTINGTON - A Mingo County man has filed a suit against a Huntington car wash after he was injured while walking to his car.

Ray E. Bevins filed a suit Dec. 1 in Cabell Circuit Court against Rollyson's Car Wash.

According to the suit, Bevins took his 1994 Chevrolet Cavalier to Rollyson's in December 2005 to it have automatically washed and hand-dried. Because the business is full-service, clients normally exit their vehicles and wait in an observation area, which Bevins did.

The suit states that during the process, cosmetic substances such as Armour All or "Tire Black" are sprayed on the vehicles.

These substances were allowed to accumulate and dry on the walkway leading from the observation to the waiting area to the exit, the suit says.

Bevins claims the substances caused the walkway to become slippery and dangerous, causing his fall.

Due to the fall, Bevins suffered a complete tear of the supraspinatus tendon as well as emotional and mental injuries.

Bevins seeks damages for medical expenses, past and future, lost wages and loss of earning capacity, physical and mental pain and suffering, annoyance, embarrassment, humiliation and inconvenience.

Attorney Mark H. Mitchell is representing Bevins. The case has been assigned to Judge David Pancake.
