Dec. 27
West Virginia University Board of Governors, for and on behalf of West Virginia University v. Richard Rodriquez
PA-Thomas V. Flaherty; Judge Robert B. Stone
* West Virginia University is seeking a declaratory judgment in the amount of $4 million against Rich Rodriquez resulting from his resignation from the position of Head Coach of the WVU football team. Rodriguez entered into an employment agreement with the University for a term of seven years from January 2003 to Jan. 2010. On June 24, 2006, an amendment to the original agreement was made that increased Rodriquez's compensation and provided for the payment by Rodriguez of liquated damages to WVU in the event he terminated the agreement prior to Jan. 2013. A second agreement was entered into on Aug. 24, 2007, that became effective retroactively on Dec. 8 2006. Rodriguez and WVU understood that the Agreement contained all terms and conditions agreed to by both parties. WVU alleges that on or before December 14, 2007, and before the termination of his agreement, Rodriquez was involved in discussions with the University of Michigan for the job of Head Coach without the knowledge or consent of WVU. Ultimately, he accepted the position prior to resigning as Head Coach of WVU.
