CHARLES TOWN - A Jefferson County man has filed a suit against a regional convenience store after he slipped on a wet spot on the floor.
Dante S. Battista filed a suit Dec. 10 in Jefferson Circuit Court against Sheetz Inc.
Sheetz is a Pennsylvania-based corporation that offers gasoline services as well as a full convenience store.
According to the suit, Battista went to the Shepherdstown location Jan. 17, 2007. While in the store, he slipped and fell on an unmarked wet spot.
Battista fell on his right shoulder and wrist, injuring both areas, and dislodged his pacemaker.
According to the suit, Battista suffered serious and permanent injuries to his person, grave physical and mental pain and anguish, emotional distress and medical costs and expenses. He also claims Sheetz was negligent, careless and reckless but not marking dangerous spots in the facility.
Battista seeks compensatory damages in excess of $5,000.
