CHARLESTON - A Logan County man has filed a personal injury lawsuit against the owners of a mine where he was injured when rock from the roof of the mine fell on him.
James G. Farley and his wife Maria filed the suit Dec. 17 in Kanawha Circuit Court against Argus Energy, which operates a mine in Lincoln County. Adam Adkins, a foreman in the mine, is also named as a defendant.
Farley worked as a roof bolter in the underground mine, and had the duties to operate machinery, which installs roof support bolts.
According to the suit, Farley was working in the mine on Jan. 12, 2007. Farley claims he was working in an area that was known for its adverse roof conditions. According to the suit, Farley was working on the roof, but was required to use bolts that were inconsistent and inadequate lengths.
While working, a rock fell and struck Farley on the head, right arm and leg. He suffered a broken nose, lacerations to his right arm and leg and nerve damage.
He had to receive medical attention and incur medical expenses.
Maria Farley claims she has loss her husband's affection and kindly services. The Farleys seek compensatory and punitive damages for their injuries.
Attorney Brian L. Ooten is representing the Farleys. The case has been assigned to Judge Irene Berger.
