Cabell man says finger was cut off at bakery

HUNTINGTON - A Cabell County man has filed a suit against Sara Lee Bakery after his index finger was cut off at the Huntington bakery.

Randy E. Layne filed a suit Jan. 11 in Cabell Circuit Court against Earthgrains Baking Companies, doing business as Sara Lee.

Layne worked on the bread line at the bakery. According to the suit, Layne was working Jan. 12, 2006. On that day, Layne was working near the overhead proofer, when there was no protective guard in place on the gear box.

According to the suit, Layne's right index finger was cut off by the exposed gears while he was inspecting the proofer to see if it was operating properly.

Layne claims Sara Lee failed to ensure there was adequate protection on the overhead proofer, which provided an unsafe working condition.

Layne claims the loss of his finger has caused serious physical and mental injury, pain, suffering, emotional distress, anxiety and inconvenience.

Tammy Layne claims she has been deprived of the care, comfort and society of her husband.

Randy and Tammy Layne seek compensatory and punitive damages.

Attorney Robert H. Miller II is representing the Laynes. The case has been assigned to Judge David Pancake.
