Boone woman sues after falling on carpet at DMV

CHARLESTON - A Boone County woman has filed a personal injury lawsuit against the Division of Motor Vehicles, claiming she was injured after she fell over loose carpet at the office.

Betty Ann Green filed a suit Jan. 8 in Kanawha Circuit Court against the West Virginia Department of Transportation, Division of Motor Vehicles and the Kanawha Mall, where the DMV office is located.

Green claims she went to the DMV on March 28, 2006. At the time of her visit, an area of carpet near the front desk had been raised, either by wires or an object on the floor.

According to the suit, Green fell on the carpet and injured the left side of her face and her left eye. She claims she also suffered medical expenses, mental anguish and emotional distress, decreased earning capacity, loss of enjoyment of life, and pain and suffering.

Green claims the DMV is negligent and seeks compensatory and punitive damages.
