Runaway tire results in lawsuit

CHARLESTON - A Kanawha County man has filed a suit against a woman after her vehicle lost a tire while driving on the interstate, causing him to collide with another vehicle while trying to avoid the tire.

Fazal A. Shere filed a suit Jan. 16 in Kanawha Circuit Court against Marie Sindledecker. According to the suit, Shere and Sindledecker were both traveling eastbound on Interstate 64 in Charleston on Feb. 20, 2007.

Shere was driving a 2000 Acura, while Sindledecker was operating a 1992 Ford Econoline E150.

According to the suit, the right rear tire on Sindledecker's vehicle came off and bounced into the middle lane where Shere was driving. Shere swerved to avoid the tire and hit Columbus Blevins who was traveling in the fast lane.

Shere claims he suffered damage to his property and suffered the loss of use and enjoyment of his vehicle. He also claims he suffered annoyance and inconvenience.

According to the suit, Sindledecker's vehicle had defects and was not properly inspected, maintained or repaired, which caused the vehicle to lose its right rear tire.

In the two-count suit, Shere seeks compensatory and punitive damages.

Attorney Marvin Masters is representing Shere. The case has been assigned to Judge Louis Bloom.
