CHARLESTON - Two individual suits have been filed against different Kanawha County fast food restaurant managers, who allegedly sexually harassed their employees while working.
Mike Taylor, a manager at Captain D's, and Oral Wayne Shamblin, a manager at McDonald's, were each named in individual suits filed Jan. 18 in Kanawha Circuit Court by attorney Paul M. Stroebel.
Elizabeth Vance, of Kanawha County, filed her suit against Shamblin, claiming she was subjected to inappropriate touching and sexual assault in June 2007. She claims he committed the acts while employed as a manager at McDonald's.
According to the suit, Vance stopped working at McDonald's after the company took no action on Shamblin after being informed of his actions.
Taylor, the manager of the Captain D's in St. Albans, is being sued by a minor, identified only as S.S. She claims she was subjected to inappropriate sexual comments, which is a violation of the West Virginia Human Rights Act.
Both Vance and S. S. claim they suffered damages and losses, including emotional distress, loss of income, humiliation, embarrassment and mental anguish.
They seek compensatory and punitive damages for their individual injuries. Vance's case has been assigned to Judge Irene Berger. Judge Tod Kaufman has been assigned the case against Taylor.
