CHARLESTON - A Kanawha County man filed a suit against a local construction company after he was injured on a job site.
Michael Wiley filed the suit Jan. 31 in Kanawha Circuit Court against EIN Services and High Point Construction Group, as well as J. L. Roush Construction. Wiley worked primarily under Roush Construction, as a laborer and carpenter.
According to the suit, Wiley was working on a project in Point Pleasant on Oct. 2, 2007. On that day, Wiley and others had been assigned the task of framing walls on the second floor of a project. They worked about 10 to 15 feet off of the ground.
Wiley claims that while working on the walls, he stepped around the unprotected stairwell of the project and fell off the edge. He suffered injuries to his jaw, wrists, back and other various parts of his body, requiring emergency surgery and other medical treatments.
Wiley claims he has suffered severe emotional and mental distress, humiliation, anxiety, embarrassment, aggravation, annoyance and inconvenience.
Delores Wiley claims she has suffered a loss of spousal consortium, severe emotional and mental distress, anxiety, aggravation, annoyance and inconvenience.
Michael and Delores Wiley seek compensatory and punitive damages.
Attorney Mark L. French is representing the Wileys. The case has been assigned to Judge Irene Berger.
