* During March of 2006, employees of Karen and Mark Shumate presented Arthur Scotchel with documents representing a purchase of Scotchel's obsolete video gaming equipment, consideration of which would be used to purchase other video gaming equipment. In March of 2008 employees of the Shumate's came to the Blue Horizon's Hot Spot to remove all video gaming machines and advise Scotchel that the documents signed in 2006 actually sold the Blue Horizon establishment to the defendants. Scotchel, who is 78, and has cognitive issues with reasoning and comprehension, claims the Shumates committed fraud and asked the court for an Ex Parte Temporary Restraining Order from allowing the video-gaming equipment to be picked up or allowing any of Blue Horizon's assets from being taken. Scotchel also seeks punitive damages, attorney fees and costs.
