CHARLESTON - A Kanawha County woman filed a suit against the local transportation authority, after she slipped and fell on water that had accumulated on a bus.
Drema Kay Newkirk filed the suit Feb. 29 in Kanawha Circuit Court, against the Kanawha Valley Regional Transportation Authority.
According to the suit, Newkirk was a fare-paying passenger March 21, 2006, on a Kanawha Valley Regional Transportation bus. The bus she was riding came to a stop, and Newkirk stood to exit. While proceeding to the front of the bus, she allegedly slipping on an accumulation of snow and water in the aisle, and fell, fracturing her left leg.
Newkirk claims the transportation authority negligently, recklessly and carelessly operated and maintained the bus, so as to cause injury.
According to the suit, she suffered physical pain and mental and emotional anguish.
She seeks compensatory and punitive damages.
Attorney Kimberly E. Williams is representing Newkirk. The case has been assigned to Judge Louis Bloom.
