CHARLESTON - A Kanawha County woman has filed a suit against a company that serviced an escalator at the Charleston Town Center, claiming she was injured when she tripped over some of their equipment.
Angeline Lowen filed a suit March 24 in Kanawha Circuit Court against Diversified Maintenance Systems Inc.
According to the suit, Lowen was riding the escalator in Sears Department Store when she tripped over a machine at the top of the escalator that was being used to service and clean the escalator.
The suit says Lowen suffered numerous injuries to her body, some of which required medical treatment.
Lowen claims there were no warning signs posted at the bottom of the escalator to inform anyone that the escalator could not be used, and the escalator was not blocked off.
Lowen claims she suffered temporary and permanent injury, medical expenses, lost wages, pain and suffering, loss of enjoyment of life and mental distress and will suffer future loss of enjoyment of life.
Lowen seeks compensatory and punitive damages.
