Roger Lee Clark, administrator of the estate of Ruby E. Clark v. Paul H. Sutherland, City of South Charleston, Nationwide Mutual Insurance Company

* Roger Clark filed a suit against Paul Sutherland and the City of South Charleston after Sutherland allegedly hit Ruby Clark. Ruby Clark died of her injuries. According to the suit, Clark was attempting to cross MacCorkle Avenue when Sutherland hit her. She was taken to the hospital where she died of her injuries. Roger Clark claims Sutherland owed the public a duty to operate his vehicle with due care, maintain a proper lookout and to yield the right of way to pedestrians. The suit also says South Charleston has a duty to inspect, maintain and repair crosswalk areas and pedestrian push buttons. Clark seeks compensatory damages.

Curtis P. Meadows v. CSX Transportation, Inc.

* Curtis Meadows claims he was injured while working as a conductor for CSX. According to the suit, he suffered a fractured pelvis and injury to his hips, including multiple abrasions and contusions. Meadows claims CSX failed to provide his with a safe workplace. He seeks compensation for his injuries and damages.

Roger W. Oiler II v. RJ Recycling Inc.

* Roger Oiler filed a suit against a RJ Recycling Inc., claiming he was injured when his supervisor cut a beltline, causing the structure they were on to collapse. According to the suit, Oiler suffered right and left wrist fractures, spinal fractures, hearing loss, loss of sensation and numbness, facial fractures, traumatic brain injury, permanent scarring and disfigurement. He seeks compensatory damages for his injuries.

Sandra K. Rabel and Charles S. Rabel v. Boll Medical Inc.
PA – C. Benjamin Salango; J- Walker
* Sandra and Charles Rabel filed a suit against Boll Medical, claiming the company did not properly fix Sandra's wheelchair. According to the suit, Sandra Rabel took her wheelchair to be refurbished. She claims the tires were not replaced. Rabel claims she was transferred from her wheelchair Feb. 5, 2008, when the brakes failed. Rabel fell to the floor and sustained a fracture to her left femur. According to the suit, Rabel required surgery, from which she developed severe complications. Due to the complications, Rabel required an extended hospitalization. Charles Rabel claims he was forced to quit his job to provide full-time, in-home care for his wife. The Rabels seek compensatory damages for their injuries.
