Thomas, heart doctor sued for malpractice

Thomas Memorial Hospital is located in South Charleston.

CHARLESTON - A Craigsville man has filed a medical malpractice suit against Thomas Memorial Hospital and one of the physicians who performed his heart surgery.

John K. Carte filed the suit April 7 in Kanawha Circuit Court, against Kourosh C. Ghalili, M.D., and the hospital.

According to the suit, Ghalili performed a surgical implantation of an automatic defibrillator into Carte's chest Nov. 8, 2006.

Carte claims that Ghalili failed to tuck the leads of the defibrillator behind it during the surgery, allowing the leads to remain too close to the incision. The suit also says Ghalili failed to properly close and provide appropriate follow-up care.

According to the suit, Carte suffered serious and permanent injuries; suffered permanent and significant scarring; suffered pain, nervousness, mental anguish, emotional distress and an impairment of the capacity to enjoy life both past and future.

Carte claims he has been left with a life-threatening medical condition, due to the doctor's negligence.

Carte seeks compensatory and punitive damages.

Attorney Tony O'Dell is representing Carte. The case has been assigned to Judge Tod Kaufman.
