Woman sues Charles Town track after fall

CHARLESTON - A Kanawha County woman has filed a suit against a local racetrack and casino after she fell while a patron at the track.

Jo Ann Stone filed the suit April 28 in Kanawha Circuit Court, against Racing Corporation of West Virginia, which owns Tri-State Racetrack & Gaming Center.

According to the suit, Stone was visiting the track April 26, 2006, when she slipped and fell on a foreign substance. Stone claims she was injured due to her fall.

The suit says Racing Corporation has a duty to all patrons to maintain the premises and products in a reasonable safe condition and to provide adequate maintenance of their products for the reasonable protection of those lawfully upon the premises.

Stone claims she incurred expenses for medicine, therapy, medical attention and hospitalization, and will continue to incur medical expenses and suffer pain of body and mind in the future.

Attorney Shannon M. Bland is representing Stone. The case has been assigned to Judge Jennifer Bailey Walker.
