Woman sues Fruth after fall at store

CHARLESTON - A Kanawha County woman is suing a local drug store claiming she suffered nearly $20,000 in medical bills after she fell in the store.

Lisa Kirk filed the suit May 7 in Kanawha Circuit Court against Fruth Pharmacy.

According to the suit, Kirk was a customer at the Oakwood Road Fruth Pharmacy on May 31, 2007. While walking down an aisle, she claims she slipped on a white substance on the floor and fell on her left side.

Kirk claims she severely injured her back, left leg and hip, incurring more than $19,626 in damages.

According to the suit, Fruth had a duty to provide a safe place for their customers, upon which to walk safely while shopping.

Kirk's husband, Ronnie Kirk, is also a plaintiff in the suit. He claims he was deprived of the consortium, society and comfort of his wife.

Together, they seek sums to compensate them for their injuries and costs.

Attorney Christinia Smith is representing Kirk. The case has been assigned to Judge Tod Kaufman.
