Family sues Kanawha schools over girl's severed finger

CHARLESTON - A Kanawha County girl and her father have filed a suit against the Board of Education after the tip of her finger was severed while she was at school.

Brittany Carter, with Mark Carter, filed the suit May 12 in Kanawha Circuit Court.

According to the suit, Carter was a student at Sissonville Elementary School on May 15, 2006. On that day, she was outside with her class when she re-entered the building.

"Entering through an open door, the door closed on her hand," the suit says. "The closing of the door on her hand resulted in the door severing (Carter's) fingertip from the rest of her finger."

According to the suit, the door was not equipped with any safety feature to prevent accidental closure from occurring.

The suit says Carter was severely injured, incurred medical expenses and will incur more in the future.

She seeks compensatory and punitive damages.

Attorney Brian O. Casto is representing Carter. The case has been assigned to Judge Tod Kaufman.
