Developer says Christian book store owes $78,000

HUNTINGTON - A Cabell County developer has filed a lawsuit against one of its tenants, seeking more than $78,000 in back taxes and other damages.

Thundering Herd Development filed a suit May 20 in Cabell Circuit Court against JARS Inc. doing business as Guiding Light Christian Store.

According to the suit, Guiding Light entered into a five-year lease agreement in 2003, with the possibility of two additional renewal terms if they complied with the terms of the lease agreement.

The suit says that under the terms of the lease agreement, Guiding Light agreed to pay rent, pro-rata real estate taxes, pro-rata insurance, and a pro-rate share of the landlord's direct expenses. However, THD claims Guiding Light has failed to make numerous rental payments when they are due.

According to the suit, Guiding Light owes THD $34,585 in rent, taxes, insurance and additional expenses. THD also seeks $43,500 for amounts due under the remainder of the lease term.

In the three-count suit, THD seeks $78,085.71, as well as the immediate and permanent ejection of Guiding Light from the premises.

Attorney Scott A. Damron is representing THD. The case has been assigned to Judge David M. Pancake.
