MORGANTOWN - Two suits have been filed against a sporting goods store in Monongalia County after two people were injured in separate incidents in the store.
Attorney Jacqus R. Williams filed both suits against Dick's Sporting Goods on June 25 in Monongalia Circuit Court. The plaintiffs are Ronald G. White Jr. and Mary Ryan. Both injuries occurred at Dick's in Granville.
According to the suits, White visited the store Oct. 7, 2006, and became interested in a piece of exercise equipment.
"In order to assess the equipment, it was necessary to move it slightly so that the movement of its parts would not be interfered with by other merchandise in close proximity," the suit says.
White pulled on the leg attachment in order to slide it forward. While being moved, one of the cords that connected to the leg attachments snapped and flipped into his face, injuring him.
The suit says the store manager determined a spring loaded locking pin was not in its proper place. White claims the store is to blame for his injuries.
Mary Ryan was a customer at Dick's on July 26, 2006, when she noticed a hammock on display.
"The hammock collapsed when she tried to get in it, and Ms. Ryan fell to the floor and landed hard on her right wrist," Ryan's suit says.
Ryan claims Dick's was negligent in placing the hammock on the floor as a display unit.
Both White and Ryan claim they have suffered damages because of their injuries sustained at Dick's. They both see compensatory and punitive damages.
