The Cincinnati Insurance Company v. Elaine Goldsmith and Suzanne M. Gandee
PA-Macel Rhodes; J-Russell M. Clawges Jr.
* A lease was executed in April 2005 between Goldsmith and Bossio Enterprises leasing property at 1068 Windsor Avenue. Goldsmith then sublet the residence to Gandee in November 2005. In August 2006, Gandee fell asleep while smoking a cigarette, causing the home to catch fire, causing damages in the amount of $112,450. Bossio executed a proof of loss claiming property damages to the Windsor Ave. residence, which Cincinnati Insurance Company paid. It now seeks judgment against Goldsmith and Gandee for $112,450, the amount paid to Bossio because of Goldsmith's and Gandee's negligence and failure to protect the property.
