HUNTINGTON – The defendants in a sexual harassment and discrimination lawsuit want the case removed to federal court.
Henry Schein Inc., Gary Anderson, Teresa Savinelli and Andrea Goldberg filed a notice of removal in U.S. District Court in Huntington.
James Rogers of Cabell County originally filed the civil action in Cabell County, alleging he suffered sexual harassment, sexual discrimination, libel, and slander at the hands of the defendants.
Rogers also claimed Henry Schein Inc., Anderson, Savinelli and Goldberg intentionally inflicted emotional distress, conducted themselves outrageously, and were negligent.
According to the removal notice, filed Aug. 25 by Theodore Schroeder of the Pittsburgh firm of Littler Mendelson, the defendants sought the removal for diversity of citizenship and the amount in controversy.
Henry Schein Inc. is a corporate citizen of Delaware with its principal place of business in New York. Anderson is a citizen of New York, whereas Savinelli and Goldberg are New Jersey residents. Rogers is a West Virginia resident.
Rogers, who was represented by Michael and Cynthia Ranson of the Charleston firm of Ranson Law Offices, is seeking an award of past and future lost wages and employment benefits as well as compensatory damages for embarrassment, emotional distress and mental anguish.
He also is requesting exemplary or punitive damages and legal fees, all of which would total more than $75,000.
