CHARLESTON -- Charleston Area Medical Center's Board of Trustees on Wednesday announced it will pay Dr. Edward Hamrick his $11.5 million settlement by Sept. 5.
The payment was ordered last month in Kanawha Circuit Court. Hamrick sued the hospital in 2004 after a fight concerning his plan to self-insure himself against malpractice.
Earlier this year, a Kanawha County jury ruled Hamrick had been treated unfairly and had his reputation damaged.
The jury awarded him $25 million. CAMC appealed what it called a "monstrous" verdict, and Webster Circuit Judge Jack Alsop – who was appointed to oversee the case -- reduced it to $10 million in July
The $11.5 million total reflects the 8.25 percent interest that has been accruing since February. But it does not include Hamrick's court.
The jury's original verdict awarded Hamrick $5 million in compensatory damages and $20 million in punitive damages. Alsop's July decision reduced that award to $2 million in compensatory damages and $8 million in punitive damages. He also denied CAMC's request for a new trial.
Both CAMC and Hamrick have agreed not to appeal the case further.
