Woman sues after parking lot accident breaks her leg

CHARLESTON - A Kanawha County woman has filed a suit against a man after her leg was broken when he hit her with his truck.

Janai Rucker filed a suit July 29 in Kanawha Circuit Court against Raymond Don McCormick of Kanawha County.

According to the suit, Rucker was taking trash to the dumpster at the Pour House Bar, on Washington Street West in Charleston on Aug. 4, 2006. McCormick went to his vehicle, a 2000 GMC Sierra Truck, and proceeded to leave the parking lot.

However, as he back out, McCormick hit Rucker with the passenger side rear bumper, knocking her over. He continued to back out and ran over Rucker's leg, breaking it.

According to the suit, Rucker suffered injury to her leg, as well as back, shoulders and neck.

Rucker claims she has suffered severe physical, mental and emotional injuries.

Rucker also suffered loss of income, loss of earning capacity, loss of tuition and fees, pain and suffering, mental anguish and emotional distress.

According to the suit, Rucker seeks compensatory and punitive damages.

Attorney Clinton W. Smith is representing Rucker. The case has been assigned to Judge Jennifer Bailey Walker.
