Ohio man sues repair company for job injury

HUNTINGTON - An Ohio man has filed a suit against a service repair company in Cabell County after he allegedly was struck by a pallet jack that had been negligently repaired.

Criss Wade of Proctorville, Ohio, filed the suit Aug. 15 in Cabell Circuit Court against Marcum Material Handling. Marcum Materials provides repair services to companies, including Black Diamond Fruit and Produce, where Wade was employed.

According to the suit, Wade was working at the Black Diamond warehouse in Huntington on Feb. 12, 2007, when he was struck by a pallet jack operated by a co-worker. The jack had been repaired and serviced by Marcum Materials.

Wade claims the brakes did not work on the pallet jack, so his co-worker was unable to stop. Wade suffered a broken ankle and significant injuries to his left leg.

Marcum Materials is negligent and dialed to provide a reasonably safe product, the suit says.

In the two-count suit, Wade claims he suffered serious bodily injury and tremendous pain and suffering, has suffered a loss of wages, loss of earning capacity, loss of ability to perform household services, loss of ability to enjoy life, humiliation, embarrassment, annoyance and inconvenience, as well as other economic and non-economic damages.

He seeks unspecified compensatory and punitive damages.

Attorney Robert B. Warner is representing Wade. The case has been assigned to Judge David M. Pancake.
