HUNTINGTON - A former Huntington Heroes football player has filed a suit against the team, seeking compensation for an injury he sustained while playing.
Marcus Hairston filed the suit in Cabell Circuit Court against Barbie Moody-Wood and the Huntington Heroes.
Hairston also played defensive end at Marshall University from 2001 to 2004.
According to the suit, Hairston severely injured his left leg during at football game with the Heroes against the Carolina Speed on March 17, 2007. Hairston claims he has suffered more than $15,000 in medical expenses so far.
Upon returning to Huntington, Hairston filed a claim with BrickStreet Mutual Insurance. Shortly after filing, he claims he was denied because the Heroes did not have workers' compensation coverage.
According to the suit, Hairston has in excess of $15,000 in medical expenses, and his financial status has been severely damaged.
In the two-count suit, Hairston claims the team intentionally misrepresented player benefits in the contract he signed in 2006.
He seeks unspecified compensatory and punitive damages.
Attorney Kerry Nessel is representing Hairston. The case has been assigned to Judge David M. Pancake.
