Motorist sues tree company, driver over injuries alleged in crash

BECKLEY—A Raleigh County man filed suit against an individual driver and his employer claiming liability in the aftermath of a 2015 motor vehicle accident that resulted in physical injuries and loss of property for the plaintiff.

William L. Turner II filed a lawsuit against Asplundh Tree Expert Co. and Allen Lee Daniels, believed to be a Fayette County resident, in Raleigh Circuit Court June 22 on charges of vehicular negligence in a January 2015 roadway collision.

According to the filing, the plaintiff was operating his 2008 Honda Ridgeline automobile on Robert C. Byrd Drive in Beckley on or about Jan. 27. The suit states that the defendant drove his vehicle in such a manner as to cause it to collide with the plaintiff’s auto.

Alleging loss of income, serious physical injuries, pain, suffering, anguish, distress, and diminished capacity to enjoy life, along with medical expenses in excess of $3,400, the total loss of his vehicle valued at over $20,000 and rental car costs exceeding $3,000, the plaintiff seeks compensatory damages, attorney’s fees, and costs.

Turner is represented by Anthony Salvatore of Hewitt & Salvatore, Fayetteville. The case has been assigned to Judge H. Louis Kirkpatrick.
