The money was deposited in the Dunbar WesBanco branch, where a CD was titled "Diane McCormick Trustee for William David White" instead of Legal Guardian. The bank refused to surrender the funds to the petitioner.

She says she was "an unsophisticated consumer" when she began to struggle with payments and the defendant began to engage in abusive and illegal debt collection.
