CHARLESTON - A Clarksburg woman has filed a suit against a Charleston mall after she was injured on the escalators located in the shopping center.
Lydia Obleada filed the suit Aug. 14 in Kanawha Circuit Court against the Charleston Town Center.
According to the suit, Obleada was at the mall Aug. 27, 2006, when she was seriously injured while using an escalator to travel between floors.
Obleada claims the escalator stopped suddenly, and she was thrown forward, causing injury her shoulder.
Obleada claims the Town Center beached its duty of care by negligently causing the escalator to stop while people were on it.
According to the suit, Obleada claims she has suffered injury to her shoulder, incurred medical expenses, endured pain and suffering, lost wages and has sustained an impaired capacity to enjoy life.
She claims she has also suffered humiliation, embarrassment, annoyance, and inconvenience, plus other damages.
Augusto Obleada, Lydia Obleada's husband, claims he has been deprived of the consortium, society and comfort of his wife.
Together, the Obleadas seeks unspecified compensatory and punitive damages.
Attorney James R. Fox is representing Lydia and Augusto Obleada. The case has been assigned to Judge Paul Zakaib.
