CHARLESTON - A Kanawha County man who was injured when a man driving intoxicated collided with him on the interstate has filed a suit against the bar where the man allegedly drank at before the accident.
Shane S. Scott filed the suit Sept. 15 in Kanawha Circuit Court against the Pour House Sports Bar Inc., which is located near Dunbar.
According to the suit, Stephen Lyons was a patron at the Pour House on Sept. 17, 2008. While there, he was served alcoholic beverages, which made him physically incapacitated, the suit says.
After leaving the Pour House, Lyons was so intoxicated he drove his vehicle south in the northbound lane on Interstate 79, the suit says.
While driving the wrong way, Lyons collided head-on with the vehicle driven by Scott, causing serious injuries.
According to the suit, Scott claims the Pour House should have trained their employees to recognize when a person is intoxicated. He also claims the bar is to blame because they allowed Lyons to exit the premises and drive while intoxicated.
Scott claims he suffered pain, suffering, humiliation, embarrassment, mental anguish and loss of enjoyment of life.
He seeks punitive damages from the Pour House, as well as any other damages the Court deems proper.
Attorney Gregory Chiartis is representing Scott. The case has been assigned to Judge James Stucky.
