Dunbar woman sues city, PSD over backed up sewer lines

CHARLESTON - A Kanawha County woman has filed a suit against her town, claiming its sewer lines backed up into her home, causing raw sewage and sewer water to damage the property.

Ruby Chappell filed a suit Sept. 17 in Kanawha Circuit Court against the Town of Dunbar and the West Dunbar Public Service District.

According to the suit, Chappell noticed raw sewage and sewer water flooding her home on Nov. 1, 2007.

The West Dunbar Public Service District had lines back up, which caused the sewage to enter Chappell's home, the suit says.

Chappell claims she suffered expenses in cleaning the sewage from her home, damage to her home and personal property, annoyance, inconvenience, mental anguish and emotional distress.

According to the suit, Chappell claims the Town of Dunbar and the PSD are responsible for her damages. She seeks compensatory and punitive damages.

Attorney Marvin Masters is representing Chappell. The case has been assigned to Judge Tod Kaufman.
