Berkeley man says dog attacked him at his home

MARTINSBURG - A Berkeley man has filed a suit after a golden retriever attacked him at his home.

Scott Daiker filed the suit Oct. 1 in Berkeley Circuit Court on behalf of himself and a minor, Joshua W. Daiker. The suit is against John D. Penwell and Gary L. Cross.

According to the suit, Penwell owned a golden retriever on May 6, 2008, which he kept at his home and allowed to run at large.

Scott Daiker claims he was on his own property when the dog attacked Joshua Daiker, biting his head and face.

Daiker claims Penwell knew of the dangers associated with letting the animal loose, but allowed it to run around.

According to the suit, Scott and Joshua Daiker claim they have suffered injuries that are permanent and lasting in nature.

In the three-count suit, the Daikers seek compensatory and punitive damages.

Attorney Terrance L. Britt is representing Daiker. The case has been assigned to Judge Gray Silver.
