CHARLESTON - Another sexual assault suit has been filed against a correctional officer at the Anthony Correctional Center.
Noel Whetsell filed the suit Sept. 25 in Kanawha Circuit Court against Dave Masters and Jim Rubenstein, the commissioner of the West Virginia Division of Corrections.
Several inmates and former inmates of Anthony have filed suits against Masters, claiming he sexually assaulted and abused them.
Whetsell claims Masters exhibited cruel and unusual behavior toward her in 2006 and 2007, sexually abusing and assaulted her while she was incarcerated.
Whetsell claims she suffered anxiety, humiliation, annoyance and inconvenience, invasion of privacy, emotional distress, pain and suffering, mental anguish and loss of her ability to enjoy life.
In the 10-count suit, Whetsell seeks compensatory and punitive damages.
Attorney Kerry A. Nessel is representing Whetsell. The case has been assigned to Judge Louis Bloom.
