CHARLESTON - A Monongalia man has filed a suit on behalf of the estate of his mother-in-law, against the nursing and rehabilitation center where she resided.
Thomas G. Freeman II filed the suit Sept. 29 in Kanawha Circuit Court on behalf of the estate of Lillian Rich. The suit is against the Oak Ridge Center.
Oak Ridge Center is a licensed professional nursing home located in Charleston.
According to the suit, Rich was admitted to Oak Ridge on Feb. 26, 2007, and remained there until Jan. 19, 2008. During her time there, Rich was a victim of negligence and abuse, the suit says.
Freeman claims his mother-in-law suffered a significant destruction of her physical and mental condition during her residency at the facility.
According to the suit, Rick suffered several injuries due to falls at the facility.
Freeman claims Oak Ridge failed to recognize the signs and symptoms of infection that has been building in Rick, and failed to monitor her condition so as to prevent sepsis.
Due to the negligence and carelessness of the professionals and non-professionals at Oak Ridge, Freeman claims Rich was caused serious injuries, resulting in pain, suffering and serious injuries, and ultimately led to her death on Jan. 22, 2008.
Rich, though the representative of her estate, and on behalf of her survivors, seeks compensatory and punitive damages.
Attorney Erin L. Winter is representing Freeman. The case has been assigned to Judge Louis Bloom.
