CHARLESTON - A West Virginia man who was incarcerated at the Stevens Correctional Center has filed a suit against the state Division of Corrections, claiming he was beaten by a fellow inmate.
Stephen McCaffrey claims another inmate, Michael Shrewsbury, beat him on Nov. 28, 2006. The suit was filed Oct. 9 in Kanawha Circuit Court.
McCaffrey claims he sustained various significant and permanent injuries, including a fractured jaw, which required open reduction and internal fixation, the suit says.
According to the suit, the beating McCaffrey suffered was the direct result of the negligence of the Division of Corrections.
McCaffrey claims Stevens Correctional Center had a low number of correctional officers for the size of the prison population; had inadequate means to ensure the safety of prisoners while they were in their cells; and failed to take proper steps to segregate Shrewsbury from the general population following a threat he made to another inmate.
McCaffrey seeks compensatory and punitive damages.
Attorney Larry O. Ford is representing McCaffrey. The case has been assigned to Judge Charles King.
