Fayette man sues ICG for injuries in mining injury

CHARLESTON - A Fayette County man has filed a suit against a coal mining company after he was injured when rocks from the mine roof fell, crushing him.

Sam Spadaro filed the suit Oct. 9 in Kanawha Circuit Court against ICG Beckley LLC.

Spadaro was employed by Cherokee Resources as a laborer at ICG's Beckley Pocahontas mine in Raleigh County on April 14, 2008.

According to the suit, Spadaro encountered severe adverse rood and rib conditions in the mine, which presented a high risk of serious injury or death to miners.

Spadaro was working in the number three entry of the Beckley Pocahontas mine when a large rock from the roof came loose and crushed him, the suit says. Spadaro claims he suffered permanent disabling injuries to his right leg.

He claims he suffered extreme pain and suffering, mental anguish, loss of wages and benefits, medical expenses, annoyance and inconvenience, permanent scarring and disfigurement and other injuries.

Spadaro claims ICG Beckley allowed the unsafe working conditions to occur. In the three-count suit, he seeks compensatory and punitive damages.

Attorney J. Kristofer Cormany is representing Spadaro. The case has been assigned to Judge Irene Berger.
