MARTINSBURG -- A Virginia-based construction and engineering firm is suing a Destiny Baptist Church and its trustees, claiming it was hired to design and build a church but was never paid.
Patton, Harris, Rust and Associates on Feb. 2 filed a lawsuit against the non-profit church as well as its trustees – Carl Que Hickerson, Jimmie Williams, Alfred Clark, Maymie Handy and Teresa Roy.
The plaintiff says it entered into two contracts with the church to build infrastructure at Destiny Point, a piece of land owned by the church, and to then design and build a church on the land with parking and adjacent recreational fields.
The contracts were finalized on Oct. 9, 2006, the complaint says.
The plaintiff contends it finished both projects. But when it came time to get paid, the church didn't keep its end of the deal.
The plaintiff wants the $125,944 that the contracts were worth, plus interest and legal fees.
