CHARLES TOWN -- An asphalt company wants a Jefferson County judge to sell off a piece of land in order to settle a $33,106 debt it says it's owed by a construction company.
Potomac Asphalt is suing Brackenridge Construction Co., WVA 340 LLC., and Wells Fargo over a project that involved the building of a grocery store in Charles Town.
The plaintiff says that Brackenridge is a company that does business with Giant Food LLC and oversaw the construction of a Martin's Food Store. WVA 340, doing business as Jefferson Crossing, owns the land on which the grocery store is built.
Potomac Asphalt said it delivered materials and did services on the grocery store project, but was never paid. The company says it filed a notice of mechanics lien on the property on Nov. 10, 2008, but then found several other companies had already filed mechanics liens on the same property.
The plaintiff wants the court to prioritize the liens and sell the property so it can recover the money it's owed, the complaint says. The plaintiff, represented by Christopher R. Moore, is requesting a bench trial.
Jefferson Circuit Judge John Yoder will preside over the case.
