Group says it is owed $70,500 in back rent

WINFIELD – A commercial real estate company says two small business owners broke a lease and owes $70,500 in back rent.

M.T.W. Partnership filed a lawsuit against Z Gallery d.b.a. The C Gallery and Wally and Mary Zigmond on Feb. 23 in Putnam Circuit Court.

The plaintiffs claim the Zigmonds entered into a two-year lease on a suite located in a shopping plaza near Hurricane, but left just a year into the lease.

The lease – on Suite 105 at 3554 Teays Valley Road -- was to run from Feb. 1, 2008 to January 31, 2010. The rent was $5,500 per month, according to the complaint.

But the defendants vacated the premises – in which they ran The C Gallery – on Feb. 5, 2009, the complaint says.

The plaintiffs are demanding damages and legal fees. They also claim they are the "rightful owners" of unspecified materials that were taken from the premises.

J. Robert Leslie is representing M.T.W. Partnership. The case has been assigned to Putnam Circuit Judge Phillip Stowers.
