CHARLESTON – A St. Albans car auction business says a Putnam County used car dealership owes $14,421 for two cars.
Capital City Auto Auction filed a lawsuit Feb. 26 in Kanawha Circuit Court against Arthur Hescht, owner of Art's Used Cars in Winfield.
The plaintiff says it entered into an agreement with the defendant for the purchase of a Toyota Camry for $8,021 on April 25, 2008 but the defendant hasn't paid the money.
The complaint also says Art's also sold a 2000 Ford Mustang through the auction on Oct. 3, 2008 for $6,400.
The Mustang was returned to the auction and the buyer was given their money back, but Art's has refused to reimburse the plaintiff for the refund, the complaint says.
The plaintiff says Art's has breached a contract between the parties by failing to pay for the vehicles. The auction claims it has made several attempts to collect the money from Art's to no avail.
The plaintiff wants the money for the cars, plus pre- and post-judgment interest on the award.
