CHARLESTON – An engineering firm is suing a hospitality company for at least $4,000, claiming it was never paid for an initial site assessment related to the construction of a hotel.
Novel Geo-Environmental filed a lawsuit March 6 in Kanawha Circuit Court against Cross Lanes Hospitality.
The complaint says the defendant bout a 2-acre tract of land in Kanawha County on Aug. 9, 2007 for $800,000. Cross Lanes Hospitality was then organized with the Secretary of State's office on Aug. 15, 2007.
The defendants last year hired the plaintiffs to perform an environmental site assessment on the land in order for the defendants to obtain financing to build a hotel.
The plaintiffs claim they performed the assessment and charged the defendant $4,000 for the work. The complaint alleges the defendants haven't paid for the assessment, but used it to obtain $5.3 million to build the hotel, which wasn't described in the complaint.
The plaintiffs say construction on the hotel is underway and that the defendants have refused to pay for the assessment work.
