CHARLESTON – Two paving companies are suing a Kentucky-based construction firm over unpaid invoices for work the companies did on two state projects.
Southern West Virginia Paving Inc. and West Virginia Paving Inc. filed lawsuits against Elmo Greer and Sons and Travelers Insurance on March 6 in Kanawha Circuit Court.
Southern West Virginia Paving alleges Elmo Greer and Sons subcontracted with them on July 14, 2006, three months after Elmo Greer won a contract to build a roadway and prepare the site for a new elementary school in McDowell County.
The subcontract called for Southern West Virginia Paving to supply labor, materials and equipment to perform work. The original amount of the subcontract was $566,690, but grew to $727,690 as Elmo Greer added on work, the complaint says.
The paving company alleges the defendant still owes $72,769 and has repeatedly refused to pay.
West Virginia Paving, in its lawsuit, claims Elmo Greer subcontracted with them for a job related to U.S. 35 in Putnam County. The initial subcontract amount was for $4.3 million, but grew to $5.2 million.
West Virginia Paving says Elmo Greer still owes $1.5 million.
Norman T. Daniels Jr. is representing both paving companies. The cases are before Kanawha Circuit judges Paul Zakaib and Jennifer Bailey Walker.
