Driver sues Rite Aid over injuries

CHARLESTON – A delivery driver for Rite Aid and his wife are suing the company after he claims an unstable load fell on him.

Christopher C. Cummings and Carrie Ann Cummings filed a lawsuit April 13 in Kanawha Circuit Court against Rite Aid of West Virginia.

Christopher claims that Rite Aid does not allow its delivery drivers to inspect loads to ensure stability before beginning routes.

On Aug. 30, 2007, Christopher claims he made a delivery in Lexington, Ky. During the unloading process, he claims some of the cargo fell on top of him, causing serious and permanent injuries.

He claims he's lost the ability to work due to the accident.

The couple is seeking compensatory damages.

Roger A. Decanio is representing the plaintiffs. The case is before Kanawha Circuit Judge Louis Bloom.
